Court Dismisses Omisore’s Bail Application

A High Court of the Federal Capital Territory on Friday denied the bail application of former Deputy Governor of Osun State, Senator Iyiola Omisore.

The former deputy governor had filed an application for bail, following his arrest and detention by the Economic and Financial Crimes Commission, EFCC over an alleged N60bn fraud.

Omisore, through his lawyer, Chris Uche, SAN, prayed the court to enforce his fundamental human rights, which he claimed, was abused by the EFCC.

Uche had yesterday informed the Justice Olukayode Adeniyi-led court that the warrant of arrest and the remand obtained by the EFCC was `mere authority’ and not in line with the constitution.

He, therefore, pleaded with the court to grant Omisore bail pending his arraignment and to order for his production in court at the next adjourned date. This, the counsel to the EFCC, Mr Takor Ndifon had objected to, saying the former deputy governor was detained based on court order.

Justice Adeniyi had adjourned the matter till today.

At today’s resumed hearing, the judge held that Omisore’s bail application was premature and incompetent, adding that he should wait the expiration of the 14 day remand order granted by a Court of Coordinate Jurisdiction before exercising his right to bail.

Justice Adeniyi furher stated that any attempt to grant the bail application will be tantamount to vacating a subsisting order.
